| What is a Community Trade Mark registration? Registration at the Community level is based on a central registration in the Union’s Trade Mark Office at Alicante (Office for Harmonisation in the Internal Market-TM). A successful application at the OHIM enables traders to protect their marks throughout the Community on the basis of a single application, rather than to have to file separate applications in each of the member states. It is a unitary right which has effect throughout the territory of the Union. The substance of CTM is designed to be an indivisible entity, having equal effect throughout the Community. It can be registered, transferred, surrendered or revoked only for the whole Community. A CTM can be licensed for parts of the Community. The CTM Regulation in many instance mirrors the provisions of the Directive. |
