| What are the consequences of a failure to record a registrable Trade Mark transaction in the UK. As long as the registrable transaction is not entered into the trade mark register, it will be ineffective against a person acquiring a conflicting interest in or under the registered trade mark in ignorance of it (s. 25(3)(a) UK Trade Marks Act 1994). If the transaction is entered into the register later than six months from the date or transaction (and the court cannot be satisfied that it was not practicable to do so earlier), the proprietor or licensee will not be entitled to damages or account of profits in infringement proceedings (s.25(4)). Finally, in the absence of registration of the license a licensee will not be entitled to the protection given by section 30 or 31, i.e. the rights and remedies of a licensee in respect of infringement action (s. 25(3)(b)), e.g. bringing an infringement action in his own name. |
