As a licensee of a Trade Mark (registered under the 1994 UK
Trade Marks Act) can I sue for infringement?



A licence to use a registered trade mark does not of itself confer
any proprietary interest but amounts to permission to use which
prevents any allegation of infringement. An exclusive licensee,
however, is given the same rights and remedies as though he were
an assignee.

Any licensee can require the proprietor to proceed against an
infringer affecting him and if the proprietor does not take any action
within two months, the licensee can then sue as though he were the
proprietor.
