| What is meant by disclaimer in European patent law? A disclaimer is not contrary to Article 123(2) EPC. Disclaimers are allowable for the following: (a)to restore novelty; (b)to restore novelty if anticipation is accidental; (c)to disclaim subject-matter which, under Article 52 to 57 EPC, is excluded from patentability; A disclaimer cannot be used to overcome inventive step or sufficiency objections and a disclaimer cannot remove more than is necessary. |
