| What is ‘file wrapper estoppel’? In the US, the files of published patents are referred to as ‘file wrappers’. This means that a patentee cannot tell the USPTO one thing, and then tell the Court something inconsistent with this when it comes to enforce the patent secured as a consequence of what the patentee has told the patent office.
