What is ‘further processing’ of patent applications at the
European Patent Office (EPC)?



Article 121 of the European Patent Convention allows the applicant
to request further processing of the European patent application, if
he fails to observe an EPO time limit.

The EPO shall grant the request if the requirements set in the
Implementing Regulations are met.
If the request is granted, there will be no legal consequences of
failure to observe the time limit.

Further processing is refused in respect of the time limit in Article
87, 108 and 112a, as well as the time limit for requesting further
processing or reestablishment of rights.
