| How do I assign a UK patent? Section 30(6) of the UK Patents Act states that any assignment or mortgage is void unless in writing and executed by all parties to the transaction or on their behalf. Baxter v Netherlands Produktielaboratorium: in equity, each assignment would be treated as an agreement to assign and that the assignee would be regarded in equity as the owner and therefore entitled to sue for infringement. |
